The DHS Final Rule is Currently Blocked

The rule was scheduled to take effect on September 15, 2026. Because of a national preliminary injunction, implementation is delayed while the litigation continues.

For now:

  • The existing Duration of Status (D/S) framework remains in effect
  • The new fixed-period admission requirements are not currently in effect
  • Students do not need to take action solely because of the blocked Final Rule
  • Existing requirements governing F-1 transfers, changes of educational level, program extensions, and practical training continue to apply

What Happens Next?

The preliminary injunction temporarily pauses implementation of the rule; it does not permanently resolve the legal challenge. Further court proceedings are expected, and the rule could be modified, reinstated, or otherwise affected as the case proceeds.

International Services will continue to monitor the litigation and any guidance issued by DHS and will provide additional updates as they become available.

What You Should Do

No immediate action is required based solely on this court decision. Continue to follow your current F-1 or J-1 requirements and existing International Services guidance.

The Office of International Services has been preparing the university for potential changes since the final rule was proposed and continues to closely monitor developments and review new information as it becomes available. This work includes:

  • Monitoring federal regulations, agency guidance and legal developments and assessing their impact on F-1 and J-1 students and scholars
  • Providing individualized immigration advising and monitoring student and scholar status, program timelines and compliance requirements
  • Providing targeted guidance to students, exchange visitors, academic and administrative units and University leadership
  • Reviewing policies, procedures, programs and processes and coordinating with departments on compliance needs
  • Coordinating with Admissions, Advisement, academic units and administrative offices to support consistent guidance and messaging
  • Assessing potential effects on students, scholars, academic programs and University operations and preparing appropriate responses
  • Providing communications, FAQs, resources, workshops, webinars and training as needed
  • Reviewing and updating policies, procedures, forms, systems, admission materials, web content and other communications as needed
  • Reviewing and strengthening guidance related to transfers, changes of educational level, program extensions and other academic mobility matters

About the DHS Final Rule

On July 17, 2026, , Establishing a Fixed Time Period of Admission and an Extension of Stay Procedure for Nonimmigrant Academic Students, Exchange Visitors, and Representatives of Foreign Information Media. The rule would replace the longstanding duration of status (D/S) framework with fixed periods of admission of no more than four years.

For F-1 students, the rule would make significant changes related to:

  • Admission periods
  • Program extensions
  • School transfers
  • Changes of educational level
  • Changes of major
  • Academic progression and mobility
  • Grace periods
  • Extension of stay procedures

The rule was scheduled to take effect on September 15, 2026, but implementation is currently blocked by the preliminary injunction.

Key Changes

The changes below describe what the DHS Final Rule proposed to change if implemented. Because the rule is currently blocked by a national preliminary injunction, these changes are not currently in effect.

  • Before September 15, 2026: Admitted to the United States for Duration of Status (D/S)
  • After September 15, 2026: Admitted to the United States for a fixed period of time, based on the length of the program of study listed on a student’s Form I-20, not to exceed 4-years, plus a 30-day period for arrival and an additional 30-day period for departure

  • Before September 15, 2026: Notes admission for 鈥渄uration of status鈥�
  • After September 15, 2026: Notes admission for a certain date

  • Before September 15, 2026: The program-extension process was handled through the Designated School Official (DSO) or Responsible Officer (RO) and SEVIS
  • After September 15, 2026: Students who need additional time beyond their AUD to complete their program, begin a new program, or apply for OPT/STEM OPT must apply to USCIS for an Extension of Stay (EOS) to remain in the United States
  • Before September 15, 2026: Can change educational level at any point during the program of study
  • After September 15, 2026: Students below the graduate level cannot change educational levels during their first year of study and cannot change to a program of study at a lower or the same educational level; students at the graduate level and above cannot change educational levels at any point during their program of study
  • Before September 15, 2026: Can change major at any point during program of study
  • After September 15, 2026: Students below the graduate level cannot change their major during their first year of study; students at the graduate level and above cannot change their major at any point during their program of study
  • Before September 15, 2026: Can transfer at any point during the program of study
  • After September 15, 2026: Students below the graduate level cannot transfer during their first year of study; students at the graduate level and above cannot their major at any point during their program of study
  • Before September 15, 2026: Can begin a new program at any level after program completion
  • After September 15, 2026: After completing an F-1 program, students may not obtain or maintain F-1 status through a program at the same or lower educational level
  • Before September 15, 2026: Have 60 days to depart the United States after completion of their program of practical training
  • After September 15, 2026: Have 30 days to depart the United States after completion of their program of study or practical training period

Duration of Status (D/S)

Duration of Status (D/S) is the longstanding immigration framework that allows eligible F-1 students and J-1 exchange visitors to remain in the United States for the duration of their authorized program, provided they maintain their immigration status and make normal progress toward completing their academic or exchange objectives.

F-1 students and J-1 exchange visitors could remain in the United States as long as they:

  • Maintained valid F-1 or J-1 status;
  • Made normal progress toward completing their program;
  • Complied with applicable immigration regulations; and
  • Maintained any required authorization for practical training or other activities.
